Kissi Agyebeng, the Special Prosecutor, has disclosed that several seasoned and senior solicitors have warned him of a plot by certain judges to have all cases his office submits to them dismissed.
During a news conference on Wednesday, November 29, in Accra, Mr. Agyebeng voiced concern over some retrograde court rulings on this plot that are impeding the OSP's efforts.
Indeed, I have had many calls from well-meaning solicitors warning me that they have overheard rumours suggesting that our friends who have been promoted to the bench and are handling cases do not tolerate criticism as well as we do—especially when it comes to being publicly called out.
He said, "And that the judges will band together against the office and throw out all our cases if the office persists in the media releases.
The Special Prosecutor used four recently dismissed corruption cases as evidence and these included the exoneration of a former government official, Cecilia Dapaah, and the denial of a court order to freeze the estate of former NPP General Secretary Kojo Owusu Afriyie, despite growing charges of corruption against his estate.
In a separate case, a High Court invalidated an OSP report that found former Commissioners of the Ghana Revenue Authority (GRA), Joseph Adu Kyei, and Col Kwadwo Damoah, as having used their positions to give favourable tax treatment to Labianca Company, a frozen foods company.
According to him, this would provide anybody who is the subject of a criminal inquiry the confidence to file a lawsuit to stop the investigation and prosecution agencies from looking into and charging them.
If it turns out that the court is biassed against the OSP or that the OSP is oriented against the judiciary, it will be completely counterproductive and that will undoubtedly have terrible effects on our nation, particularly when it comes to combating corruption and the glee of the corrupt, he stated.
